Terms of Service

0. Who we are

The Service is operated under the unregistered trading name Gizo AI("we", "us", "our") by its sole proprietor as an early-stage venture that has not yet been incorporated as a company or LLP. The proprietor's place of business is Bandipora, Jammu & Kashmir, India. References to "Gizo AI" in these Terms mean that operator. For legal notices, contact legal@gizoai.com. This does not limit your rights under mandatory consumer-protection law.

1. Acceptance

By creating an account or using Gizo AI ("Service") you agree to these Terms, the Privacy Policy, the Acceptable Use Policy, and the AI Usage Policy. If you do not agree, do not use the Service.

3a. Website Builder — what it does and does not do

The Website Builder produces static HTML/CSS/JS (and, on request, a React/Vite export) from a natural-language prompt. It is a drafting assistant, not a turnkey business platform. In particular:

  • Generated sites typically require review, editing, and iteration before they are production-ready. A single prompt does not guarantee a finished, error-free, or brand-accurate website.
  • Backend features (authentication, databases, payments, email, custom server logic) are not automatically provisioned. Where the builder scaffolds such UI, you must connect and configure the underlying services yourself.
  • Custom domains require you to control DNS and, in most cases, front the domain with a proxy (e.g. Cloudflare) for HTTPS. We do not automatically issue TLS certificates for arbitrary third-party domains.
  • Generated code may include third-party libraries or references and may reproduce patterns, text, or imagery similar to public sources. You are responsible for licensing, attribution, accessibility, and legal compliance of anything you publish.
  • We do not guarantee SEO ranking, uptime of external services, or that generated content is unique, non-infringing, or fit for any specific purpose.

2. Eligibility

You must be at least 13 years old (or the minimum digital-consent age in your region) and legally able to form a binding contract. If you use Gizo AI on behalf of an organization, you represent that you are authorized to bind it.

3. The Service and AI output

Gizo AI orchestrates third-party AI models. Output can be inaccurate, biased, or fabricated and is not professional advice. See the Disclaimer and AI Usage Policy. You are solely responsible for reviewing, verifying, and deciding how to use output.

4. Your content and licenses

You retain ownership of the prompts and files you submit ("Input") and, subject to provider terms and these Terms, the outputs generated for you ("Output"). You grant Gizo AI a worldwide, non-exclusive, royalty-free licence to host, process, transmit, and display Input and Output solely to operate, secure, and improve the Service. We do not use your private Input to train public AI models.

5. Credits, plans, and billing

  • Paid plans are billed in advance and renew automatically until cancelled.
  • Credits are consumed by AI operations at rates we may adjust with notice.
  • Credits are non-transferable, have no cash value, and expire per plan terms.
  • Prices, features, and limits may change; material changes will be communicated in advance.
  • Taxes may apply based on your billing address.

6. Third-party services

The Service integrates third-party providers (OpenAI, Google AI, Anthropic, Replicate, ElevenLabs, Deepgram, Supabase, Cloudflare, Resend, Cashfree, etc.). Your use of features depending on them is additionally subject to their terms. We are not responsible for their acts or omissions.

7. Acceptable use

You will comply with the Acceptable Use Policy. We may suspend or terminate accounts for violations, without refund.

8. Intellectual property

The Service, our software, brand, and content (excluding user Input/Output) are owned by Gizo AI and its licensors and protected by law. No rights are granted except as expressly stated. Report infringement per the Copyright & DMCA Policy.

9. Warranties disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF AI OUTPUT, OR UNINTERRUPTED OPERATION.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIZO AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100.

11. Indemnification

You will indemnify and hold harmless Gizo AI from any claim, damage, liability, or expense (including reasonable legal fees) arising out of your Input, your Output, your use of the Service, or your violation of these Terms or applicable law.

12. Suspension and termination

We may suspend or terminate access at any time for violation of these Terms, risk to the Service or others, non-payment, or as required by law. You may terminate at any time by deleting your account. Sections that by their nature should survive will survive.

13. Changes to the Service or Terms

We may modify the Service or these Terms. Material changes will be notified in-app or by email. Continued use after changes take effect constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-laws rules. Subject to mandatory local consumer law, the competent courts at Bandipora, Jammu & Kashmir, India, where the operator's place of business is located, will have exclusive jurisdiction, with appellate jurisdiction lying with the High Court of Jammu and Kashmir and Ladakh. To the extent permitted by law, you and Gizo AI waive any right to a jury trial and to participate in class actions. Your non-waivable local consumer rights are not affected.

15. Miscellaneous

These Terms are the entire agreement between you and Gizo AI on this subject. If any provision is unenforceable, the remainder stays in effect. Failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition.
